TERMS OF SERVICE

01: AGE OF AUTHORIZATION (18+)

TEXT AN EX is strictly restricted to individuals who are eighteen (18) years of age or older. We do not design for, market to, or knowingly collect data from minors. By initiating a session, you legally certify that you meet this age requirement. If a minor is found to be utilizing the platform, the account and all associated data will be immediately incinerated.

02: LIABILITY SHIELD

TEXT AN EX is a digital entertainment product designed to simulate emotionally complex, and often toxic, interactions. It is explicitly not a substitute for professional therapy, psychological counseling, or mental health treatment. By using this service, you acknowledge that the outputs are generated by an artificial intelligence model instructed to behave in a volatile or distressing manner based on your custom inputs. Delaporte Ventures LLC assumes absolutely zero liability for any emotional distress, psychological discomfort, or real-world relationship consequences that arise from your use of the simulation. You are choosing to enter the simulation at your own psychological risk.

03: INPUT VIOLATIONS

To calibrate the simulation, you may provide historical text logs. You are strictly prohibited from inputting sensitive, third-party Personally Identifiable Information (PII). This includes, but is not limited to, real addresses, social security numbers, banking details, or employer information of your actual former partners.

Furthermore, any attempt to "jailbreak" the underlying AI models to generate illegal content, or any attempt to use our SMS infrastructure to contact, harass, or threaten an actual human being, is a critical violation.

Violations will trigger an immediate, permanent ban. Your account will be terminated, your data will be purged, and you will not receive a refund.

04: FINANCIAL

Creating the simulations and securing SMS infrastructure incurs immediate, irreversible compute costs. Therefore, all sales are absolute and final.

We do not offer refunds under any circumstances. If you terminate a session early, if you find the simulation too distressing, or if you feel the generated persona was "not toxic enough," your transaction is still considered fully consumed upon initialization. You not a guaranteed emotional resolution.

05: GOVERNING JURISDICTION

This platform is engineered and operated by Delaporte Ventures LLC. Any legal disputes, claims, or controversies arising from your use of TEXT AN EX will be governed exclusively by the laws of the State of Louisiana. Venue for any legal action shall be restricted to the state and federal courts located within New Orleans, Louisiana.

06: SMS PROGRAM TERMS

By establishing a session, you agree to participate in the TEXT AN EX SMS program. Users will receive simulated SMS messages from an AI persona acting as a former partner based on user prompts.

• Message Frequency: Message frequency varies by duration of the session and user interaction.
• Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the shortcode or number you are messaging. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us for that session.
• Customer Care: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at help@textanex.com.
• Carriers: Carriers are not liable for delayed or undelivered messages.
• Message and Data Rates May Apply: Please note that message and data rates may apply for any messages sent to you from us and to us from you.
